Terms of Use for the Yandipay Mobile Application

These Terms of Use (hereinafter "Terms") apply to the use of the Yandipay mobile application (hereinafter "the Application"), published by Yandipay, a general partnership, with its registered office at 2-804 rue Ells, Sherbrooke QC, registered with the Registraire du Québec under number 3381711194 (hereinafter "the Publisher").
By installing or using the Application, the user (hereinafter "the User") unconditionally accepts these Terms.
1. Purpose of the Application
The Application allows Users to:
• scan product barcodes available on shelves in partner stores;
• add these products to a virtual shopping cart;
• proceed with payment through the Application, using the available payment methods;
• present proof of purchase or a receipt when leaving the store if required.
The Application only allows the purchase of products in partner stores identified within the Application.
2. Access and Use Conditions
2.1. Access
The Application is available free of charge through official stores (Android/iOS). Certain services, including product purchases, involve payments that remain the User's responsibility.
2.2. Account Creation
To use the main features, the User must create an account by providing:
• Full name;
• Address;
• Email;
• Phone number;
• Compatible payment method.
The User warrants that all information provided is accurate and commits to keeping it up to date.
2.3. Equipment and Connection
The User is solely responsible for:
• their mobile device,
• their network connection,
• the proper functioning of the camera required for product scanning.
3. Scanning and Purchase Service Operation
3.1. Product Scanning
The User can scan product barcodes (maximum 5 items) in-store in order to:
• obtain information (price, description, promotions…);
• add items to their shopping cart.
3.2. Prices and Availability
The prices displayed in the Application are those provided by the partner store. In case of display errors or product unavailability, the store remains solely responsible.
3.3. Payment
Payment is made through the Application using the payment methods added to the account by the User:
• bank card, Debit or Credit;
• electronic wallet;
• other compatible payment solutions.
Payment triggers the generation of an electronic receipt, which the User must be able to present at the request of store staff.
3.4. Exit Verification
The partner store may verify purchases. The User agrees to present their proof of purchase.
4. User Obligations
The User agrees to:
• use the Application in accordance with the law and these Terms;
• not scan or attempt to purchase a product without legally acquiring it through the intended process;
• not attempt to bypass payment systems or technical protections;
• comply with the rules of partner stores;
• not use the Application for fraudulent or illegal purposes.
Any attempted fraud may result in:
• immediate account suspension,
• prohibition of access to the service,
• civil or criminal proceedings by the store or the Publisher.
5. Publisher Obligations
The Publisher commits to:
• providing a service consistent with its description;
• ensuring reasonable maintenance of the Application;
• implementing appropriate security mechanisms.
However, the Publisher cannot guarantee:
• the complete absence of technical errors,
• permanent availability of the service,
• the accuracy of price/product data provided by stores.
The Publisher's customer service will be available for any necessary corrections within reasonable timeframes that ensure User satisfaction.
6. Personal Data and Privacy
Data collected through the Application (identity, purchase history, payment methods, browsing data, etc.) is processed in accordance with:
• the General Data Protection Regulation (GDPR),
• applicable national laws.
A separate document, the Privacy Policy, details:
• the data collected,
• the purposes,
• the retention periods,
• the User's rights (access, rectification, deletion, objection).
7. Intellectual Property
The Application, its content (text, images, logos, algorithms, interfaces) and its trademarks are protected by intellectual property law. Any unauthorized reproduction, modification or use is prohibited.
8. Liability
The Publisher is not responsible for:
• price or stock errors for which the store alone is responsible;
• damage resulting from misuse of the Application;
• the inability to use the Application due to the User's network or equipment issues;
• indirect damages, data loss or financial losses.
The partner store remains responsible for the compliance of products sold.
9. Account Suspension or Deletion
The Publisher may suspend or delete a User's access in case of:
• non-compliance with the Terms,
• suspicious or fraudulent activity,
• judicial requisition.
The User may delete their account at any time through the Application.
10. Modifications to the Terms
The Publisher may modify these Terms at any time. Users will be notified through the Application. Continued use of the Application constitutes acceptance of the new Terms.
11. Applicable Law and Disputes
These Terms are governed by Quebec consumer protection laws and regulations. Any dispute shall be submitted to the competent courts of the Publisher's registered office jurisdiction, unless otherwise provided by law.
